België: Voorstel tot hervorming vennootschapsbelasting

Eerder dit jaar maakte minister van Financiën Johan Van Overtveldt zijn plannen bekend om de vennootschapsbelasting grondig bij te sturen. Daarbij lag eerst een duaal systeem op tafel: ofwel kozen bedrijven voor het tarief van 33,99% met aftrekposten ofwel voor een lager tarief zonder aftrekposten. Die piste bleek budgetmatig niet haalbaar zodat er in de uiteindelijke nota slechts sprake is van een eenvoudig tarief dat elk jaar gradueel zal afnemen tot 20% tegen 2020. Hoe zal deze ‘nieuwe’ vennootschapsbelasting er uit zien?

Recent case law: interest deduction limitation to prevent base erosion

On 5 June 2016 and on 8 July 2016, the Dutch Supreme Court decided in two important cases on the rebuttal rules in the interest deduction limitation to prevent base erosion included in article 10a of the Dutch Corporate Income Tax Act (“CITA”). Netherlands: The advantages of a Dutch holding company

In recent times, there has been increasing interest in the Netherlands from multinational companies that wish to avoid supposed tax havens and blacklisted jurisdictions.
